How HB 105 Changed Who is Required to Have an IID in Maryland

Before the passage of HB 105, ignition interlock devices were primarily required for those with repeat DUIs or with very high BAC levels.

What HB 105 Changed

Maryland’s HB 105 built upon Noah’s Law to further strengthen the state’s efforts to combat drunk driving. Noah’s Law was named after Officer Noah Leotta, who was killed by a drunk driver in 2014. HB 105 introduced additional provisions aimed at expanding the scope of Noah’s Law, including the following:

  • IIDs are now required for Probation Before Judgment (PBJ), which is a special type of probation that had previously exempted the mandate of IIDs.
  • Ignition interlock devices are now required for those with a BAC level between 0.07 percent and 0.799 percent.
  • Drivers who refuse to submit to a breath or blood test when suspected of DUI and those who commit a DUI with a minor in the vehicle are now required to have an IID installed.
  • HB 105 also allows certain DUI offenses to be expunged. Drivers who received probation before judgment may be eligible to apply for expungement 15 years after the completion of probation.  

How Long Must IIDs Be Installed?

For first-time offenders, the IID must be installed for six months. For those convicted of a second DUI or DWI, the IID must be installed for one year. Third or subsequent DUI offenses require three years of mandated IID installation. Early installation of the IID provides credit from the day of installation, shortening the period of usage needed and encouraging quicker compliance. Failure to comply with IID laws can result in license suspension, probation violations, fines, or reinstated judgments.

How Much Does an IID Cost in Maryland?

The cost of an ignition interlock device can be substantial. The cost of installation usually ranges from $100 to $180. The monthly lease fee is generally $80-$100. Some companies may charge calibration fees, which are typically required every 1-3 months. The state of Maryland offers financial assistance for IIDs to those who qualify based on income and public assistance status.

The program employs a tiered system, where the percentage of costs covered by the individual decreases as their income decreases. Individuals at or below 100 percent of the federal poverty level will typically pay only 10 percent of the total IID costs.

Those with incomes between 101 percent and 200 percent of the federal poverty level may pay 25 percent of the total IID costs, and those between 201 and 300 percent of the federal poverty level would pay approximately 50 percent of the total IID costs. The court will determine whether an individual qualifies for assistance, providing documentation directly to the interlock provider.
