What Are the Penalties for Child Pornography?
The crime of child pornography in the state of Maryland is subject to up to 10 years in prison for a first offense and up to 20 years in prison for each subsequent violation. Fines of $25,000 and $50,000, respectively, may also be assessed. A conviction for the possession of child pornography will result in a mandatory Tier I sex offender registry for 10 years.
A conviction for the creation or distribution of child pornography will result in a mandatory Tier II sex offender registry for 25 years. Multiple convictions for either of these child pornography crimes can result in being on the sex offender registry for life. There are also collateral consequences, including the inability to obtain employment, a place to live, a federal student loan for college, or a professional license.
